When you browse the Platform and the Mobile Applications 58 Facettes and the use of the Online Sales Services offered there, personal data concerning you is collected and processed by our services.

YOUR PERSONAL DATA

1. Data controller

Personal data concerning you, collected for the execution of your orders placed within the platform and mobile applications 58 Facettes, are jointly processed by the company 58 Facettes SAS, company operating the Platform and the mobile Applications 58 Facettes, and each Seller with whom you place an order

Personal data concerning you are also processed under the responsibility of the company. 58 Facettes SAS for the purposes of commercial prospecting, navigation analysis, audience measurement, behavioral advertising, statistical studies, to conduct satisfaction surveys and to combat banking fraud.

2. Why do we process your data and on what legal basis?

Management of your orders placed through the Platform and Mobile Applications 58 Facettes (payment, delivery, customer service, connection with merchants, etc.): execution of sales contracts

3. What personal data do we process about you?

We collect and process in particular:

  • the personal data that you provided on our Platform when creating your account (email, telephone number, surname, first name, address, password, etc.);
  • information relating to orders you place on the Platform (product purchased, transaction number, delivery address, etc.);
  • information relating to your means of payment (bank card number, bank card expiry date, visual cryptogram) via a secure payment provider, which alone has access to this data;
  • if you have accepted the registration of your bank card: information relating to your bank card (name of the bank card holder, the last 4 digits of the bank card number and its expiry date) via a secure payment provider, which alone has access to this data;
  • the information you provide to us when you contact customer service or the merchant through the Platform 58 Facettes (content of exchanges, nature of the complaint, return of products, etc.);
  • your connection and navigation data within the Platform 58 Facettes (IP address, the products and pages you viewed or searched for);
  • data relating to the consultation of emails that we send to you for statistical and commercial prospecting purposes;
  • the information you provide when you leave a review on the Platform;
  • information about our advertisements that you view;
  • the information you provide when you participate in promotional operations, competitions or events that we organize.

4. How long do we keep your data?

We keep your data in our database only for the time necessary to achieve the purposes pursued and then archive them with restricted access for an additional period in order to fulfill our legal and/or regulatory obligations regarding archiving as well as for the duration of the limitation periods in force. At the end of this additional period, your data is permanently deleted from our databases.

5. Who is your data transmitted to?

5.1 To our service providers

Your data is accessible to the service providers we use to subcontract all or part of the processing we carry out with your data (hosting of the Platform and data, maintenance, sending of order confirmation emails, emailing, secure payment, etc.).

The subcontractors we use provide the guarantees required by the applicable regulations on the protection of personal data. They only have access to the data necessary for the performance of their services and are not authorized to process your data for other purposes. We also have branded with each of them agreements to guarantee the security and integrity of your data and their processing in compliance with applicable regulations

58 FACETTES uses several third-party services, including Facebook, Firebase, And Klaviyo, to improve the user experience and ensure the proper functioning of the application. By opening and using the application 58 FACETTES for the first time, the user is asked to give his explicit consent for certain usage events, such as installations and openings of the application, to be transmitted to these services for measurement and technical diagnostic purposes. Without this explicit consent, no events related to the use of the application will be transmitted to these third-party services.

  1. Facebook Ads SDK : Used to measure the effectiveness of advertising campaigns and report anomalies related to the installation or opening of the application. No personally identifiable information is transmitted.

  2. Firebase : Used to monitor app performance, diagnose technical errors, and analyze user engagement. No personally identifiable information is collected or shared. Firebase collects anonymous or aggregated data to improve the app."

  3. Klaviyo: Used to send personalized push notifications and marketing emails to users. These notifications and emails may include information about new products, promotions, order confirmations, or reminders of activity on the platform. Klaviyo also allows these communications to be personalized based on the user's past interactions with the application.

The use of Klaviyo for sending push notifications and of marketing emails requires the explicit consent of the User. When opening the application for the first time, the User will be asked to give consent to receive push notifications sent via Klaviyo. These notifications may include information such as order confirmations, promotional offers, or reminders of activity on the platform.

The User can manage or revoke at any time his preferences concerning:

  • THE push notifications from the app settings or those of their device.

  • THE marketing emails by unsubscribing via the links provided in each email or via their user account settings.

Without explicit consent, no push notifications or marketing emails will be sent.

5.2 To Sellers of the Platform and Mobile Applications and our carriers

The data necessary for the management of your orders are transmitted to the Sellers from whom you have purchased a product through the Platform 58 Facettes.

The data used to ensure the delivery of your order is also transmitted to the carrier that you have selected or that will be proposed to you when you place your order.

5.3 To the authorities

Your personal data may be disclosed to authorities in accordance with a law, regulation or by virtue of a decision of a competent regulatory or judicial authority.

In general, we undertake to comply with all legal rules which could prevent, limit or regulate the dissemination of information or data and in particular to comply with the applicable regulations regarding data protection.

5.4 In the event of acquisition, merger, transfer of activity

In the event that the company 58 Facettes SAS or part of its activities would be acquired by a third party company or merged, we will inform you in advance of the transfer of your data and the possibility of opposing it.

6. What are your rights over your data and how can you exercise them?

You have the right to obtain from our services:

  • confirmation as to whether or not personal data concerning you is being processed, and, if so, to have access to it;

6.2 How to exercise your rights?

7. Is your data transferred outside the European Union?

Some processing operations that we entrust to our subcontractors may be carried out outside the European Union. 1. What is a cookie?

A cookie is a small alphanumeric file that is placed in the terminal of the User's computer, smartphone, tablet, mobile, etc., when connecting to the Platform.

2. What cookies are used on the Platform?

Within our Platform, we use cookies to enable:

  • to improve your navigation within the Platform and thus allow you to use its various functionalities, such as in particular to allow you to identify yourself and connect to your user account;
  • to establish statistics and volumes of traffic and use of the various elements making up the Platform (sections and content visited, paths, date and time of consultation, etc.), allowing the improvement of the interest and ergonomics of the Platform;
  • to recognize your browser as a previous registered visitor, to remember any preferences that may be sent when using the Platform by your browser and in particular to remember your shopping cart;
  • to measure the audience of our Platform;

SPECIAL CASE OF MOBILE APPLICATIONS 58 FACETTES

When you install a Mobile Application 58 Facettes, we will ask for your explicit consent for any data collection related to the use of the Mobile Application, tracking and sharing with third-party services (for example for analysis and advertising purposes).

We use third-party services such as Facebook Ads SDK and Firebase for analytics, user engagement, and advertising purposes. These services may collect anonymized or aggregated data, which does not include any personally identifiable information. We ensure that these third parties comply with data protection regulations, and users can manage their data preferences through the app settings.

58 Facettes will only send push notifications for transactional purposes (such as order confirmations or shipping updates) or promotional offers if you have explicitly consented to this. You can manage your notification preferences directly through the app settings or by contacting customer support.

You can request the deletion of your account and all associated data at any time via the application settings (Form) or by contacting our customer support. Once the request is received, your data will be permanently deleted within 30 days, unless required by law to retain it for a longer period.

In cases where we transfer your data to countries outside the European Economic Area (EEA), we ensure that these transfers are carried out in accordance with the GDPR, using mechanisms such as Standard Contractual Clauses (SCCs) to ensure the protection of your data.
